WASHINGTON (TND) — A 31-year-old Colorado woman who authorities said had a sexual relationship with a 13-year-old boy and became pregnant with his child won't be facing jail time, according to reports.
The Fountain Police Department said Andrea Serrano was arrested in July 2022 on felony charges, including sexual assault on a child by one in a position of trust, as well as sexual assault on a child.
Police said she admitted to having sex with the teenager and was booked into the El Paso County Criminal Justice Center.
Now, she has accepted a plea deal with prosecutors and the teenager's parents are outraged.
I feel like my son is robbed of his childhood," the teen's mother told KKTV. "Now he's having to be a father. He's a victim, and he's going to have to live with that for the rest of his life."She also said she is frustrated, noting that she believes things would be different in a case involving an older man and a younger girl.
“I feel like if she was a man and he was a little girl, it would definitely be different," the teen's mother told KKTV. "They would be seeking more. I feel like because he is not a woman, they are not. They are having compassion for her."
KKTV reported that Serrano will be required to register as a sex offender, and the judge could sentence her to 10 years to life on sex offender intensive supervised probation.
"Serrano will avoid any jail time, since the district attorney’s office dropped the original charges to a lesser charge that does not come with mandatory jail time," according to KKTV.
KKTV also noted that the teen's family plans to ask the courts to give their son custody of the baby.
